Arbitration

Misty has been a member of the American Arbitration Association's panel of arbitrators since 2022 and has served as an arbitrator in dozens of construction-related matters since then. Qualifications to become a construction arbitrator include a minimum of 10 years of legal practice with at least 50% of practice for the past 10 years devoted to the practice of construction law, plus attendance at a two-day training workshop and ongoing CLE requirements.

Misty's construction law experience includes serving as an advocate for all sectors of the construction industry and she has represented owners, contractors, suppliers, and design professionals in arbitration, state court, and federal proceedings.

Misty is also board-certified in Construction Law by the Texas Board of Legal Specialization, which requires passing a one-day comprehensive exam on Construction Law, references from other attorneys submitted every 5 years, and  60 hours of Construction Law related CLE every 3 years.

In addition to satisfying the minimum  CLE requirements for maintain her bar licensure and Construction Law Specialization, Misty is also a member of the Texas Bar College, which requires 80 hours of CLE every 3 years.

Mediation

Misty has served as a mediator for construction disputes since 2023. She is a certified mediator, having received 40 hours of mediator training to meet the requirements of Tex. Civ. Prac. & Rem. Code section 154.052. 

As a mediator, Misty seeks to aid parties in resolving their disputes to avoid the continued expense and inconvenience of other dispute resolution mechanisms. Misty's experience as a construction legal advisor, advocate, and arbitrator brings understanding to the technical concepts that are unique to construction-industry disputes.  Misty has handled disputes involving delay claims, defect claims, lien & bond claims, payment disputes, and complex contract disputes.
