Misty is an experienced litigator who has successfully tried cases in state court, federal court, and arbitration and will fight vigorously when necessary to protect her clients' rights. At the same time, she recognizes that litigation can be a drain on company resources and works to guide clients to develop business strategies to minimize the need for litigation. To this end, Misty works with clients to review, prepare, and negotiate contracts to put them in the best position possible when starting a new project or business relationship. Misty also works to guide clients when disputes arise during the course of a project and to help clients protect their payment rights through lien and bond claims.

Misty also has experience in employment law and provides employer-side services to her business clients, including preparing employee handbooks, confidentiality agreements, non-competition agreements, and advising clients when employment related disputes arise.

Finally, Misty is an experienced mediator and arbitrator for construction-related disputes.

Experience

Misty H. Gutierrez has been practicing Construction Law for more than 15 years and is Board Certified in Construction Law by the Texas Board of Legal Specialization. Misty advises clients from all segments of the construction industry regarding contract formation and negotiations, pre-litigation dispute management, and formal dispute resolution involving breach of contract claims, delay claims, foreclosure of mechanic's and materialman's liens, design defect claims, and other construction-related claims. Misty also serves as an arbitrator and mediator for construction related disputes.

Misty has been a speaker for the the Texas Bar Association Construction Law Section, the American Bar Association Forum on Construction Law, the Dallas Bar Association Construction Law Section, and various trade and industry groups. Misty is a co-editor of Construction Checklists, Second Edition: A Guide To Frequently Encountered Construction Issues, and has published articles in the Construction Law Journal and The Construction Lawyer. Misty graduated with honors from SMU Dedman School of Law and received B.A. from Texas Tech University.

Board Certified

Misty has been Board Certified in Construction Law by the Texas Board of Legal Specialization since 2017. There are fewer than 150 attorneys Board Certified in Construction Law in Texas. Board Certification requires that an attorney:

  • Practice law full time for at least 5 years as an active member of the State Bar of Texas;

  • At least 5 years of Construction Law experience with a yearly minimum 40% substantial involvement with Construction Law matters;

  • Qualified vetted references from judges and lawyers in the area;

  • Complete 60 hours of TBLS approved continuing legal education in Construction Law;

  • Meet all of the TBLS Standards for Attorney Certification; and

  • Pass a comprehensive 6-hour examination in Construction Law.
